ACCEPTANCE OF TERMS

Sonic Identity provides information and services, to you, the user, conditioned upon your acceptance, without modification, of the terms and conditions of use.

Please note, by using Sonic Identity, you legally agree to be bound by the terms and conditions below:

 If you do not agree to these terms and conditions, please do not use Sonic Identity.

Sonic Identity reserves the right, at Sonic Identity's sole discretion, to change, modify, add or remove portions of these Terms periodically. Such modifications shall be effective immediately upon posting of the modified agreement to the website. Your continued use of Sonic Identity following the posting of changes to these Terms will mean that you accept those changes.

Use of Sonic Identity constitutes full acceptance of and agreement to the Terms; if a user does not accept Sonic Identity's Terms, he or she is not granted rights to use Sonic Identity as defined herein, and should refrain from accessing Sonic Identity.

Sonic Identity reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any or all Sonic Identity (or any part thereof). Sonic Identity shall not be liable to any user or other third party for any such modification, suspension or discontinuance except as expressly provided herein.

 

1. NO UNLAWFUL OR PROHBIITED USE

By using the information provided by this website, you warrant to Sonic Identity that you will not use Sonic Identity name or any of the content obtained from this site, for any purpose that is unlawful or prohibited by these Terms. If you violate any of these Terms, your permission to use Sonic Identity automatically terminates.

 

2. DESCRIPTION OF SERVICES

Sonic Identity is owned and operated by Sonic Identity for the purpose of documentation and discussion (the "Purpose"). Sonic Identity provides information and help for educational purposes and for development of homebrew games and software for many game console systems development tools. Such as boot disks and Flash cartridges.

Refer to section 2 below for legal information.

 

4.CONTENT

All information, data, text, software, music, sound, photographs, graphics, video, messages, or any other materials whatsoever (collectively, "Content"), whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such Content originated. This means that the user, and not Sonic Identity, is entirely responsible for all Content that he or she uploads, posts, emails or otherwise transmits via Sonic Identity. No user shall transmit Content or otherwise conduct or participate in any activities on Sonic Identity that, in the judgment of Sonic Identity, is likely to be prohibited by law in any applicable jurisdiction, including laws governing the encryption of software, the export of technology, the transmission of obscenity, or the permissible uses of intellectual property.

Sonic Identity reserves the right to refuse or delete any Content of which it becomes aware and reasonably deems not to fulfill the Purpose. In addition, Sonic Identity shall have the right (but not the obligation) in its sole discretion to refuse or delete any Content that it reasonably considers to violate the Terms or be otherwise illegal. Sonic Identity, in its sole and absolute discretion, may preserve Content and may also disclose Content if required to do so by law or judicial or governmental mandate or as reasonably determined useful by Sonic Identity to protect the rights, property, or personal safety of Sonic Identity' users and the public. Sonic Identity does not control the Content posted to Sonic Identity and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will Sonic Identity be liable in any way for any Content, including, but not limited to, liability for any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via Sonic Identity.

Each user, by using Sonic Identity, may be exposed to Content that is offensive, indecent or objectionable. Each user must evaluate, and bear all risks associated with the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

 

5. NO RESALE OF SERVICE

You agree not to sell, resell, or offer for any commercial purposes, any portion of Sonic Identity, use of Sonic Identity, or access to Sonic Identity.

 

6. GENERAL PRACTICES REGARDING USE AND STORAGE

Sonic Identity may establish general practices and limits concerning use of Sonic Identity. While Sonic Identity will use reasonable efforts to back up site data and make such data available in the event of loss or deletion, Sonic Identity has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by any Sonic Identity site. Sonic Identity reserves the right to mark as "inactive" and archive accounts and/or Content that are inactive for an extended period of time. Sonic Identity reserves the right to change these general practices at any time, in its sole discretion, with notice to users and the public as described in Section 1 above.

 

7. LINKS

Sonic Identity, any Sonic Identity site or a third party may provide links to other websites. Sonic Identity exercises no control whatsoever over such other websites and web-based resources and is not responsible or liable for the availability thereof or the Content, advertising, products or other materials thereon. Sonic Identity shall not be responsible or liable, directly or indirectly, for any damage or loss incurred or suffered by any user in connection therewith. Your access and use of linked websites, including information, material, products and services therein, is solely at your own risk.

The Sonic Identity sites' Privacy Statement is applicable only when you are on Sonic Identity site. Once you choose to link to another website, you should read that website's privacy statement before disclosing any personal information.

 

8. INDEMNITY; DISCLAIMER; LIMITATIONS OF LIABILITY

Each user shall indemnify, defend and hold harmless Sonic Identity, and its parent corporation and affiliates and their respective officers, employees and agents, and each of Sonic Identity's website partners, from any and all claims, demands, damages, costs, and liabilities including reasonable attorneys' fees, made by any third party due to or arising out of that user's acts or omissions, including claims arising out of that user's use of Sonic Identity; his or her submission, posting or transmission of Content or his or her violation of the Terms.

EACH USER'S USE OF THE Sonic Identity SITES IS AT HIS OR HER SOLE RISK. Sonic Identity respects the intellectual property rights of others, and requires that the people who use Sonic Identity do the same. It is our policy to respond promptly to claims of intellectual property misuse.

Is emulation really legal?

 

gba roms Yes it is. The case of SONY V. CONNECTIX found that unauthorized emulation

 is perfectly legal. It was the decision of the court that CONNECTIX had the right to emulate

the SONY Playstation and that reverse engineering of the Playstation BIOS for such a cause

 fell under fair usage. As a result of this case CONNECTIX was allowed to release it's

 Virtual Gaming Station for the Mac OS.

 

Ok, so it's legal, but is it right?

 

Emulation simply makes one hardware platform act like another. There is nothing

wrong with making the hardware you own behave the way you want it to. That is

 exactly what software is for it makes the hardware you own behave in a useful

 manner. Emulation is not used simply for playing console games on a PC.

 Emulators exist for all kinds of hardware and all types of platforms. Console

 emulation is only part of a very large emulation community.

 

 

Are ROM images legal?

 

Yes, under very specific circumstances. Section 117 of the US Copyright Law

gives the owner of a software package the right to make an additional copy

under certain provisions. If you adhere to the provisions then making ROM

 images is perfectly legal. However, legislation has been passed to prevent

software piracy that makes game copying devices illegal. Using such a device

 to create a ROM image makes the resulting image illegal as well. Also you

have to remember that there is a large amount of freeware / public domain

 roms that you can download from the Internet, and only way to play them is

to use emulator or a flash card!

 

Is distributing ROM images legal?

 

No, not clearly. Individuals and Companies have a right to back up their

software. This does not give them the right to distribute that copy to others,

 even provided they also own a legal copy of the software. So, in short,

it is perfectly legal for you to copy a software package you own, but not for

 you to give that copy away.

 

 

Is Flash Advance Linker and Flash Cards legal?

 

That's like asking if CD Recodes are legal. Yes they are 100% legal. Flash

 advance linker is a Gameboy Advance backup unit and as such it is perfectly

 legal as long as you use it for legal purposes! You could go on internet and

 download all gba commercial game roms and than play them on GBA using

Flash Advance Linker and FA card - that would be illegal! But if you use it

 to play backups of games that you own or play Freeware and Public Domain

 roms from the Internet than you are not doing anything illegal!
